Planning Email and SMS Outreach: Questions to Resolve First

A planning checklist for teams considering email and SMS outreach. Confirm contact basis, opt-outs, sender identity, and applicable rules with qualified counsel before launch.

Before adding SMS to a business outreach program, decide whether the channel fits the audience and purpose, and ask qualified counsel to assess the rules that apply to your messages and recipients. Email and SMS should not be treated as interchangeable channels. This guide helps organize the review; it is not legal advice or a statement of TCPA requirements.

Review the audience and contact basis

Record where each contact detail came from and what use is permitted under your agreements and applicable rules. Do not treat possession of a phone number or email address as permission to contact someone. Confirm the intended recipients, sender identity, business purpose, and source of any consent or other contact basis with the responsible owner.

Plan opt-outs and ownership

Decide how the team will receive, record, and honor unsubscribe requests, opt-outs, suppression instructions, and do-not-contact requests. Identify who monitors replies and requests to stop, how quickly the team responds under its applicable rules, and which records need updating. Do not assume a campaign tool applies suppression across every system or channel.

Check the channel and workflow

Before sending, have the responsible reviewer confirm that the message, channel, audience, timing, and sending process meet the requirements that apply to the campaign. Keep email and SMS workflows separate where their permissions, records, or sending controls differ. Do not rely on generic templates or platform settings to establish compliance.

The Dureach Acceptable Use Policy requires users to have a lawful basis for contacting recipients, use accurate sender identity, honor opt-outs and suppression, and follow applicable anti-spam, telemarketing, electronic communications, consent, and privacy laws. For product-supported email campaign setup, see the campaign guide. It does not document an SMS sending feature.

Questions for the review owner

  • Which jurisdictions, recipient types, and communication purposes are in scope?
  • What source and permitted use apply to each address or number?
  • How will the team receive and honor stop requests across the workflows it controls?
  • Who approves the content, audience, timing, and sending process?
  • What records should the team retain, and for how long, under its own requirements?

Resolve these questions with qualified counsel and the relevant internal owner before sending. This checklist does not determine legal compliance.
